Grand Pacific Resorts BeCause Destination Matters Promotion Official Rules Grand Pacific Resorts Inc. BeCause Destination Matters promotion is subject to all applicable federal, state and local regulations. Void where prohibited or restricted by law. A booking or reservation made on the Grand Pacific Resorts Inc. system will not improve your chance of a winning submission. Eligibility • The promotion is only open to U.S. residents who are at least 18 years of age at the time of submitting the entry. Employees of Grand Pacific Resorts Inc., and its affiliate companies, and members of their immediate families are not eligible to submit an Entry or to Vote. • Proof of age, identity, and eligibility must be submitted upon request. • Void where prohibited, taxed, or otherwise restricted by law. • Grand Pacific Resorts Inc. reserves the right to disqualify any entrant or vote if these Official Rules are not followed. Submissions/Applications • There is no specific minimum or maximum file size for each submission. There is no specific restriction on content, but Participants are encouraged to share genuine stories to inspire lives. Grand Pacific Resorts Inc. reserves the right to decline to post a submission for any reason. • Applications may be submitted on the Grand Pacific Resorts Inc. website, or by submitting your application via mail to: Grand Pacific Resorts Inc., 5900 Pasteur Court, Carlsbad, CA 92008. • There is no fee or purchase necessary for submission. Participant is not required to book a vacation or reservation on the Grand Pacific Resorts Inc. website to be eligible for submission. • Participants may submit an unlimited number of original submissions. • By submitting an entry, each Participant agrees to, where legal, Grand Pacific Resorts Inc.’s use of his or her name and/or likeness for advertising or publicity purposes in any and all media now or hereafter known without compensation and, upon request, will provide consent to such use in writing. Copyright Release • By submitting an entry, each Participant agrees, releases, authorizes and assigns to Grand Pacific Resorts Inc. the full and exclusive right to use of his or her original creative work whether written, verbal, audio, pictorial, in any media or mode now or hereafter known without compensation, and upon request will provide written consent to post, re-post, feature, duplicate, distribute, modify, alter, comment, or blog, upon all or any portion of the Giving Back story submission, both for commercial or non-commercial purposes. • Every Participant must represent that s/he has obtained a Photo Release for any persons appearing in photos or videos. Written documentation may be required for any winning submission. • Every Participant must certify the authenticity for personally created work. • Submissions will be posted and featured for public viewing. Grand Pacific Resorts Inc. is not responsible for the capture and or re-distribution of the story, photos, videos, etc. • Grand Pacific Resorts Inc. is not responsible for the accuracy of the facts recited in any story submission. Public Charity • Nominated public charity must be a properly formed non-profit corporation, registered in any of the 50 U.S. states, current and in good standing in its domicile state. • Nominated public charity must be qualified under the laws of the United States as an I.R.C. 501(c)(3) organization and its state counterpart. If your story features a charity or public cause which has not received a 501(c)(3) exemption or is located outside the U.S., we encourage you to nominate a qualified public charity recipient which can best support your cause. For example, if your passion is support for our military families serving on foreign military bases, select a qualified U.S. public charity that offers services or sponsors military families. • Donations by Grand Pacific Resorts Inc. do not reflect an endorsement of the charity or its charitable purposes. • Grand Pacific Resorts Inc. reserves the right to independently verify the qualifications of any U.S. public charity nominated by a Participant. If the designated public charity is declared for any reason disqualified as required hereunder, Grand Pacific Resorts Inc. will donate the designated gift to another qualified U.S. public charity in lieu thereof. • By accepting a donation as the nominated public charity of the winning entry, the recipient public charity agrees to, where legal, Grand Pacific Resorts Inc.’s use of its name and/or likeness for advertising or publicity purposes in any and all media now or hereafter known without compensation and, upon request, will provide consent to such use in writing. Voting • Votes are accepted, whether or not personally identifiable, but all persons casting votes agree to the basic terms and conditions and privacy policy applicable for all visitors to the Grand Pacific Resorts Inc. website. • There is not a restriction on the number of votes that may be submitted from a single person, however, each vote must be made by single entry and not by an automated process. • Votes may be submitted on the Grand Pacific Resorts Inc. website, which may be accessed directly or by link from our social media pages. Votes may also be submitted via mail to: Grand Pacific Resorts Inc., 5900 Pasteur Court, Carlsbad, CA 92008. • To be counted all votes must be submitted no later than 11:59 p.m. on the last day of the calendar quarter. • An affirmative vote may be submitted with personal comment and or personal testimonial for the Giving Back story submission or the nominated public charity. Grand Pacific Resorts Inc. encourages positive comments, posts, re-posts to promote the Giving Back story and nominated public charity, but reserves the right to decline, delete, or de-publish any comment at its discretion. • Only the original Participant will be honored in the BeCause Destination Matters donation to public charity. • No purchase is necessary to vote. Selection of Winners • The voting periods will be based upon four calendar quarters ending on March 31, June 30, October 31, and December 31 of each year. • Contest stories will be posted for public voting based upon the date of acceptance of the completed submission. • All stories submitted within the voting period will be eligible only within the voting period in which the story was posted. • The story can be re-submitted an unlimited amount of times, but it must be newly submitted in each voting period in which it is nominated. • The Participant/author of the winning entry will not be awarded any compensation or other financial benefit for personal gain. • The winning entry and the nominated public charity and recipient of the donation will be published on Grand Pacific Resorts Inc.’s website. To receive written notification, please submit a request to Grand Pacific Resorts Inc. at 5900 Pasteur Court, Suite 200, Carlsbad, California 92008. Release of Liability • By participating in the entry submission or voting, all participants agree that Grand Pacific Resorts Inc. is not responsible or liable for any injury, loss, illness, litigation or damage (whether actual, consequential, foreseeable or not) that may occur from participation in any portion of the promotion. Term • The BeCause Destination Matters pilot program will be launched at 8:00 a.m. Pacific Daylight Time on July 1, 2014, and will continue until June 30, 2014, and thereafter for quarterly periods at Grand Pacific Resorts Inc.’s discretion. • Grand Pacific Resorts Inc. reserves the absolute right to cancel the BeCause Destination Matters contest at any time. Notification of cancellation will be posted on our website. Exclusive Right of Sponsorship • Grand Pacific Resorts Inc. has the sole power and absolute discretion, at any time, for any reason, and without prior notice to terminate this BeCause Destination Matters promotion; or to interpret the rules and make decisions regarding the interpretation of the rules. • All decisions of Grand Pacific Resorts Inc. in regard to this BeCause Destination Matters promotion and interpretation of these Official Rules are final and legally binding and conclusive on all matters. No Participant or nominated public charity shall have any right to challenge or contest any decision of Grand Pacific Resorts Inc. concerning the BeCause Destination Matters promotion, its rules, interpretations, determinations, eligibility, verification, timeliness, winners, or any other matters. • Grand Pacific Resorts Inc. is not responsible for any incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any service, or any other error or malfunction, or for late, stolen, lost, postage due, or illegible or misdirected entries, votes or mail. • All federal, state and local laws and regulations apply.
